We allow certain online advertising partners to collect information about you through cookies, trackers and other technologies which they use to deliver targeted advertisements and assist us with advertising-related analytics. We do not sell or share for cross-context behavioral advertising or targeted advertising purposes any of the other categories of Personal Data we collect.

No Profiling to Facilitate Decisions with Legal or Other Significant Risks

We do not engage in the automated processing of Personal Data to create profiles about individuals that are used in furtherance of decisions with legal or other similarly significant effects, such as the provision or denial of financial or lending services, housing, insurance, or access to essential goods or services.


6. Notice at Collection: How Long Will We Keep Your Personal Data

We will retain your Personal Data as long as necessary to carry out the function for which you provided it to us, including but not limited to maintenance of your active or subscription account, to comply with legal obligations or to protect our legal rights. You may close your account, unsubscribe from our emails, and otherwise limit our use of your Personal Data by contacting us. However, unless you also request deletion of your Personal Data, we may retain it for an additional period as is permitted or required under applicable laws. Even if we delete your Personal Data, it may persist on backup or archival media for an additional period

Additional Information About We May Disclose Personal Data and Purposes for Disclosures

For purposes consistent with this Privacy Policy, we may also disclose your Personal Data with our parent companies, subsidiaries and/or affiliates for the purposes identified above or as required or permitted by law to comply with a subpoena or similar legal process or government request, or when we believe in good faith that disclosure is legally required or otherwise necessary to protect our rights and property or the rights, property or safety of others, including to law enforcement agencies, and judicial and regulatory authorities. We may also disclose your Personal Data to third parties to help detect and protect against fraud or data security vulnerabilities. And we may disclose or transfer your Personal Data to a third party in the event of an actual or potential sale, merger, reorganization of our entity or other restructuring.

We may offer you financial incentives, including discounts, for providing Personal Data to us. For example, we provide consumers with a 10% discount only for their first order with us upon providing an email address, or a 10% discount for any initial and/or follow-up subscription order when purchasing selected products during check-out.

When we offer financial incentives to you, we believe that the value of the differing pricing or services you will receive exceeds the cost of providing your Personal Data. Your participation in these programs is completely optional and subject to the terms provided to you at the time you sign up. 9. Opt-Out of Email Communications

We may use your Personal Data to send advertisements, marketing promotions, offers and marketing surveys via email. To stop receiving future email communications from us, you can follow the instructions set forth at the bottom of our promotional emails to unsubscribe.

Our Site (or emails) may contain links to third-party websites, including social media buttons that link to social media platforms. This Privacy Policy does not govern how those third parties or social media platforms collect or use personal information and we do not endorse nor responsible for the policies and practices employed by, or the content of, third-party websites or social media platforms. We suggest contacting those sites directly for information about their privacy policies and practices.


11. How We Secure Your Personal Data

We secure your Personal Data by: keeping Personal Data up to date; storing and destroying it securely; not collecting or retaining excessive amounts of data; protecting Personal Data from loss, misuse, unauthorized access and disclosure, alteration, and destruction; and ensuring that appropriate technical measures are in place to protect Personal Data. However, no network, server, database, or Internet or e-mail transmission, is ever fully secure or error free. 12. How Do We Use Cookies?

What Are Cookies?
We may use cookies, pixel tags, web beacons and other similar tracking technologies (“tracking technologies”) to automatically collect information through our Site. Tracking technologies are small data files placed on your computer, tablet, mobile phones or other devices that record certain pieces of information when you visit our Site. We may use these tracking technologies to help identify irregular behavior, prevent fraudulent activity, improve security, simplify your subsequent interactions with the Site, save your preferences for a better user experience, and help us understand how you interact with our Site.

We use Google Analytics to evaluate the use of our Site. Google Analytics uses cookies and other identifiers to collect information, such as how often users visit our Site, what pages they visit when they do so, and what other websites they visited prior to visiting our Site. We also use Google Ads Remarketing, including the Google Display Network, to deliver focused online behavioral advertisements to you both on and off the Site. Do Not Track (DNT) is an optional browser setting that allows you to express your preferences regarding tracking by advertisers and other third-parties. We do not currently respond to DNT signals. We recognize the Global Privacy Control signal.


13. What Data Is Not Covered By The Privacy Policy?

The Privacy Policy does not apply to the following categories of personal data:
  • Non-Personally Identifiable Data: Any non-personally identifiable data we collect, including, without limitation, Log Data, domain names of your Internet Service Provider, your approximate geographic location, a record of your usage of the Site, the time of your usage, and aggregated personally identifiable information, but only to the extent the foregoing cannot be used to specifically identify you.
  • Aggregated Personal Data: Any aggregated Personal Data that can no longer be used to identify you will be treated as non-personally identifiable data under this Privacy Policy.


14. Minors

We do not knowingly collect, sell or share for purposes of behavioral advertising any Personal Data from children under the age of 16, nor do we target our emails, products or services to them. Minors should not submit any Personal Data through the Site. If you believe a child under the age of eighteen (18) may have provided Personal Data to us through the Site, please contact us at support@oseamalibu.com, and we will use reasonable efforts to delete it from the Site and our files.


15. International Privacy Laws

If you are visiting the Site from outside the United States, please be aware that you are sending information (including Personal Data) to the United States where our servers are located. That information may then be transferred within the United States or back out of the United States depending on the type of information and how it is stored by us. We will hold and process your Personal Data in accordance with privacy laws in the United States and this Privacy Policy. Please note that privacy laws in the United States may not be the same as, and in some cases may be less protective than, the privacy laws in your country, and while in the United States Personal Data may be subject to lawful access requests by government agencies.


16. What If We Change This Privacy Policy?

We may occasionally make changes to this Privacy Policy from time to time. If changes are made, we will update the Privacy Policy and reflect the date of such modification in the date noted above. If the changes are material (e.g., using your Personal Data for a new purpose not covered by this Privacy Policy), you will be notified via a notice on our Site.

18. U.S. State Data Privacy Rights

Residents of certain U.S. states may have rights regarding their Personal Data under state law, as set forth below. We describe below how to exercise your rights if you are a resident of one of these states.

Verification of Requests
When you exercise rights other than opt-out rights, we will take steps to verify your identity. We will ask you for two pieces of personal information, depending on the nature of your request, and attempt to match those to information that we maintain or collect about you.

If we are unable to verify your identity with the degree of certainty required, we will not be able to respond to the request. We will notify you to explain the basis of the denial.

Non-Discrimination
If you exercise any of the rights explained in this Privacy Policy, we will continue to treat you fairly. If you exercise your rights under this Privacy Policy, you will not be denied or charged different prices or rates for goods or services, or provided a different level or quality of goods or services than others.

California Privacy Rights

If you are a California resident, the California Consumer Privacy Act (“CCPA”) and other laws provide you with the following rights with respect to Personal Data we collect and process:

Right to Know
You can ask us for the following information from us with respect to the Personal Data we have collected about you since January 1, 2022:

  • • Categories of sources from which such personal information was collected;
  • • Categories of personal information that the business sold or disclosed for a business purpose about the consumer;
  • • Categories of third parties to whom the personal information was sold or disclosed for a business purpose; and
  • • The business or commercial purpose for collecting or selling your personal information.

Right To Delete
You have the right to ask us to delete Personal Data we have collected from you. We will do so, subject to the exceptions under the law.

Right To Correct
You have the right to request that we correct Personal Data we hold that you believe is not accurate, taking into account the nature of Personal Data and purposes for processing such information.

Right to Opt-Out of Sale/Sharing
With respect to those categories of Personal Data that we sell to third parties or share with third parties for the purpose of cross-context behavioral advertising, you have the right to opt out of such sales and sharing.

Opt-out Preference Signals
An opt-out preference signal is sent by a platform, technology, or mechanism on behalf of consumers and communicates a consumer’s choice to opt out of the sale and sharing of personal information for cross-context behavioral advertising with all businesses that recognize the signal, without having to make individualized requests. The signal can be set on certain browsers or through opt-out plug-in tools.

We recognize the Global Privacy Control signal and do so at the browser level, meaning it does not apply to Personal Data we may collect offline or that we may associate only with your name or email address. For example, if the signal is sent through a specific browser, we will recognize it for that browser only, and only with respect to the identifiers associated with that browser. California Shine the Light
California Civil Code Section 1798.83, also known as the “Shine the Light” law, permits California residents to annually request, free of charge, information about the personal information (if any) disclosed to third parties for direct marketing purposes in the preceding calendar year. Exercising Your Rights
To exercise your rights to know, delete or correct your Personal Data, or to ask a question, submit your request via email at support@oseamalibu.com or contact us at toll-free 1-888-282-4264. For such requests, we will first acknowledge receipt of your request within 10 business days of receipt of your request. We will then provide a substantive response to your request as soon as we can, generally within 45 days from when we receive your request, although we may be allowed to take longer to process your request in certain jurisdictions or under certain circumstances. If we expect your request is going to take us longer than normal to fulfill, we will let you know.

We will also require that you verify your identity directly with us or confirm with us that you provided the agent with permission to submit the request.

  • Requests to Opt Out: If the agent submits a request to opt out of the sale of your Personal Data or the sharing of your Personal Data for purposes of cross-context behavioral marketing, the agent will need to provide us with your signed permission indicating the agent has been authorized to submit the opt-out request on your behalf.


Please note that this subsection does not apply when an agent is authorized to act on your behalf pursuant to a valid power of attorney. Any such requests will be processed in accordance with California law pertaining to powers of attorney.

Other State Privacy Rights

State privacy laws in Colorado, Texas Virginia grant residents of each state the following rights with respect to their Personal Data:

Right to Know: The right to confirm whether or not we are processing their Personal Data and to access such data.

Right to a Copy: The right to a portable copy of the Personal Data we have collected from them, subject to certain exceptions.

Right to Delete: The right to request deletion of their Personal Data that we have collected about them and to have such information deleted, subject to certain exceptions.

Right to Correct: The right to ask that we correct inaccuracies in their Personal Data, taking into account the nature of Personal Data and purposes of processing such information.
